Terms of Service

These Terms of Service (“Terms”) govern your use of this website and your participation in swim lessons and related services provided by Coach Clayton Swim Lessons, a sole proprietorship operated by Clayton R. in Princeton, Missouri (“we,” “us,” or “the Instructor”). By using this website, submitting a request form, or enrolling a swimmer in lessons, you agree to these Terms. If you do not agree, please do not use the website or our services.
1. Services
We provide private, semi-private, and group swim instruction for swimmers of varying ages and abilities, including Mommy & Me, beginner, intermediate, advanced, swim team, and competitive skill development. Lessons are typically hosted at the Stacy Center in Princeton, Missouri, or another facility agreed upon in advance. We are an independent instructor and are not an agent of, or affiliated with, any host facility.
2. No Guarantee of Enrollment or Results
Submitting an information request does not create an enrollment, reserve a lesson time, or form a contract. A lesson slot is confirmed only when we expressly confirm it in writing (email or text). Swimming is a skill developed over time; we make no guarantee of any particular outcome, skill level, competitive result, or timeline.
3. Eligibility and Parental Consent
You must be at least 18 years old to submit a request or enroll a swimmer. A parent or legal guardian must enroll any swimmer under 18 and is responsible for that swimmer’s conduct, attendance, and payment obligations.
4. Scheduling, Payment, and Cancellation
- Lesson rates, packages, and payment methods are provided at the time of enrollment.
- Payment is due according to the schedule communicated at enrollment. Unpaid balances may result in suspension of lessons.
- Please provide at least 24 hours’ notice to cancel or reschedule. Lessons canceled with less notice, or missed without notice, may be charged in full.
- If the Instructor cancels a lesson, or if a lesson is canceled due to facility closure, weather, or unsafe pool conditions, you will be offered a make-up lesson or a credit.
- Recurring enrollment continues until either party gives notice of discontinuation.
5. Safety, Supervision, and Conduct
- A parent or guardian must remain on the premises for the duration of any lesson involving a minor swimmer.
- You must disclose any medical condition, allergy, seizure disorder, physical limitation, or behavioral consideration that could affect the swimmer’s safety in the water.
- All participants must follow the host facility’s rules and the Instructor’s directions. We may end a lesson without refund if conduct creates a safety risk.
- Swim lessons reduce, but never eliminate, the risk of drowning. No person is ever “drown-proof.” Constant adult supervision around water remains your responsibility at all times.
6. Assumption of Risk and Release
You acknowledge that swimming and aquatic instruction involve inherent risks, including slips and falls, water inhalation, injury, illness, and drowning. To the fullest extent permitted by Missouri law, you voluntarily assume those risks on behalf of yourself and any swimmer you enroll, and you release the Instructor from claims arising out of those inherent risks, except for claims arising from the Instructor’s gross negligence or willful misconduct. A separate written waiver may be required before lessons begin, and that waiver controls if it conflicts with this section.
7. Limitation of Liability
To the maximum extent permitted by Missouri law, the Instructor is not liable for indirect, incidental, special, consequential, or punitive damages. Total liability arising out of the services or this website will not exceed the amount you paid to the Instructor in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot lawfully be limited.
8. Photography and Media
We will not photograph or record a swimmer, or use any image for promotional purposes, without your separate written permission. You may withdraw that permission at any time by contacting us.
9. Website Use and Intellectual Property
All content on this website, including text, layout, graphics, and logos, is owned by Coach Clayton Swim Lessons and may not be copied, reproduced, or used commercially without written permission. You agree not to misuse the site, attempt unauthorized access, or submit false information.
10. Disclaimer
The website and its content are provided “as is” without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Information on this site is general in nature and is not medical, safety, or legal advice.
11. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the current version. Continued use of the website or services after an update constitutes acceptance of the revised Terms.
12. Governing Law and Venue
These Terms and any dispute arising out of them or the services are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. You and the Instructor agree that the exclusive venue for any dispute is the state or federal courts located in Mercer County, Missouri, and you consent to the personal jurisdiction of those courts. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
